  • Document generation and export capabilities
  • Clinical workflow management tools

3. Eligibility and Account Registration

3.1 Eligibility

The Service is available only to licensed healthcare professionals. By registering, you represent that you:

  • Are a licensed medical professional or authorized healthcare worker
  • Are at least 18 years of age
  • Have the legal capacity to enter into these Terms

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any purpose other than legitimate clinical documentation
  • Upload, transmit, or store any content that violates patient privacy or applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Share your account credentials with others
  • Use the Service in any way that could damage our reputation

5. Patient Data and Privacy

You acknowledge that you are the data controller for any patient information processed through the Service. You are responsible for:

  • Obtaining appropriate patient consent for digital documentation
  • Ensuring compliance with applicable healthcare privacy laws (HIPAA, GDPR, local regulations)
  • Verifying the accuracy of clinical documentation before use
  • Maintaining appropriate records as required by law

6. AI-Generated Content

Important: AI-generated clinical notes are provided as a documentation aid only. You must review, verify, and approve all content before clinical use.

The Service uses artificial intelligence to transcribe and structure clinical dictations. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • You are solely responsible for reviewing and verifying all AI-generated content
  • You must not use AI-generated content without appropriate clinical review
  • The Service does not provide medical advice or clinical decision support

7. Intellectual Property

The Service and its original content, features, and functionality are owned by OncoDictate and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of your clinical documentation content. By using the Service, you grant us a limited license to process and store your content as necessary to provide the Service.

8. Fees and Payment

Certain features of the Service may require payment. You agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable except as required by law or as explicitly stated.

We reserve the right to change our fees upon 30 days' notice. Continued use after a fee change constitutes acceptance of the new fees.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend access for maintenance, updates, or emergency repairs. We will provide advance notice when possible.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCODICTATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR PATIENT OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless OncoDictate and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may export your data before termination.

13. Governing Law and Disputes

These Terms shall be governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
